By using FastGames' website at www.fastgames.io (or any of its affiliated websites) and/or the associated mobile application(s) (together, the "Site"), you agree to be bound by FastGame's Terms and Conditions and Privacy Policy set forth below (collectively, the "Terms and Conditions"). This document forms an agreement between FastGame and you on the use of the Site and the use of our Services (the "Agreement").
If you do not agree with the Terms and Conditions, you may not use the Site or enjoy the use of our Services.
These capitalized terms shall have the following meanings under this Agreement unless the context otherwise requires:
You are required to register an account with us to use our Services with our provided online authorization methods such as Gmail/Facebook/Telegram.
Upon your Registration, we will grant you a personal, revocable, non-transferable, non-exclusive right to use the Services.
Only persons who are 18 years and above and are entitled to enter into legally binding contracts may access and use the Site as a User and submit a Booking Order or make any orders, purchases, or any other form of request unless you have the approval and under the supervision of your parent or legal guardian. You acknowledge that this is also necessary to book venues and many other financial transactions taking place in the nature of e-commerce.
Data
In order to use our Services on the Site, you must provide certain particulars, which include your name, a valid email address, payment details, and other personal information such as your contact number and messaging userIDs so as to enable our provision of services to you.
You expressly agree to provide, transmit, upload, import, and make accessible all necessary information or documents to us for the purpose of, among others, activating the Services on the FastGame, conducting background checks, fulfilling the on-boarding and know-your-customer requirements, where necessary, and tailoring our services to your needs.
You must provide true, accurate, up-to-date, and complete information in all fields indicated as mandatory when creating and updating an account.
You expressly grant FastGames the authorization to disclose, access, collect, retain, use, and release your Data to any Recipient, Provider, or Enterprise (as applicable) in connection with the Services and/or for the purpose of, among others, activating the Services on the FastGame, conducting background checks, fulfilling the on-boarding and know-your-customer requirements of the Provider and/or Enterprise.
With this Data, we may offer you benefits such as the accumulation of reward points which can be used for redemption/subsidies of other services on our Site. We do, however, reserve the right to accept or decline a new registration and to cancel an account at any time.
Any information collected from you may be used for, among others, the following purposes: (a) to improve the Services, (b) to confirm your identity, (c) to properly administer the Services, (d) to communicate with you, (e) to handle requests for data access or correction, (f) to facilitate the on-boarding procedures of any Recipient, Provider, or Enterprise, (g) for statistical research purposes, (h) for processing, storage, analysis purposes outside of Singapore, and (i) any other purpose in connection with the use of the FastGame and the Services.
Consent
You expressly agree that as a User, you are solely responsible for ensuring that your continued use and access to the FastGame do not and will not violate any policies, bylaws, or instructors that are imposed on the User, and that all communication or activities through the FastGame shall be deemed to have been authorized. We reserve the right to review all communication or activities through the FastGame and to remove any undesirable materials at its sole discretion should there be any Malicious Intent we detect, formally or informally, direct or indirect from Us. As such, we may block, restrict, suspend, disqualify, or terminate your use of FastGame services (including bookings, creation, refunds, redemptions of points, etc.) to you at any time without notice.
You agree that the quality of our services and legal/policy adherence by our FastGame is subject to how accurate/consistent the data you provide to us are and absolve us for any inaccuracies that may arise if you or third parties provide us with any incorrect data. As such, you agree to keep the information in your account and profile current and shall promptly update your account and profile with any changes to information in all fields indicated as mandatory.
FastGame may change, suspend, or discontinue any aspect of the Services at any time, including the availability of any feature, database, or content. FastGame may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
You agree that we will store this data on our own servers, that may or may not be centralized. For the purpose of rendering our Services, FastGame shall have the right to store your Data on any cloud FastGame maintained by third-party service providers or our own solutions, subject to appropriate standards under the applicable laws. For the avoidance of doubt, FastGames shall not be liable for any direct or indirect loss or harm you or other Users may suffer or incur as a result of any acts, omissions, errors, defaults of such third-party service providers. This includes but is not limited to any loss of data, opportunities, or any loss or damage you may suffer or incur in connection with the cloud FastGame maintained by third-party service providers.
FastGames shall have the right to aggregate your Data for the purposes of conducting internal research and statistical analysis. Any Data obtained for these purposes shall be anonymized in its entirety. Given the anonymity of the Data, unless otherwise required by law, no consent shall be obtained for the collection, use, and/or disclosure of such anonymized Data by FastGames.
You agree to absolve FastGame in any improper data usage or loss that may arise by/from these solutions or 3rd-party providers.
Should you wish to (a) access the Data collected by FastGames about you (for which FastGames may charge an administrative fee), or (b) correct any information that FastGames holds about you, or (c) withdraw consent for the collection, use, or disclosure of such Data by FastGames, you may contact our Customer Service Manager at support@FastGames.co to make a request.
FastGame shall use commercially reasonable efforts to make the Services available, except for planned downtime and any unavailability caused by circumstances beyond FastGame's reasonable control or expectation, including without limitation Force Majeure Events or internet service provider or energy failures or delays.
FastGame reserves the right to momentarily interrupt the Services for testing, traffic performance enhancement, or maintenance purposes. FastGame shall schedule maintenance of its FastGame to the extent practicable during non-peak usage hours.
FastGames may, at its sole discretion, provide updates, additional features, functionalities, and content to improve the Services at any time without notice. FastGames reserves the right to charge a fee or commission for the Services rendered through the FastGame and/or under the User Interface.
For the avoidance of doubt, FastGames shall not be liable for any direct or indirect losses or damages arising from an inability to access the User Interface and from any use of the User Interface which is beyond FastGames's control. FastGames shall not be accountable for any indirect losses or damages suffered or incurred by you as a result of the access and/or use of the User Interface by you. This includes but is not limited to any loss of data or any loss or damage you may suffer or incur in connection with the use of the User Interface by you.
Commitment To You
FastGames shall provide remote standard technical support to you from Monday through Friday from 8:00 a.m. to 5:00 p.m., Singapore Time (GMT+8), excluding public holidays, throughout the duration of the Agreement, subject to the support and maintenance policies provided by third-party service providers. Technical support requests may be sent to support@FastGames.co. FastGames shall use commercially reasonable efforts to respond to you within 48 hours after receipt of any technical support requests.
Cross-Border Usage
You are aware that the FastGame can be accessed from countries around the world and may contain references to services and content that are not available in your country, and you are residing in a jurisdiction where it is not prohibited by law to offer or use FastGames's Services. It is your responsibility to ensure that you are legally allowed to use FastGames's Services where you are located.
If you choose to access the Site or use our Services from locations outside the country you signed up and are logged in from (e.g., trying to book a Singapore game from Vietnam where you are at), you do so at your own risk and shall be solely responsible for complying with applicable laws and all legal consequences arising therefrom.
You are aware that in cross-border investigations, we may need to extend data usage depending on the leading investigative body - thus, data protection laws in the country you originally registered in may be more or less protective than ones than if you accessed our services from another country.
We will work with authorities in said countries with full cooperation and sharing of our collected Data from you should there be an authoritative request by these countries to do so (e.g., criminal investigations, breach of data/privacy laws, scams, abuse, etc.).
You confirm that your entry into, exercise of your rights and/or performance of or compliance with your obligations under this Agreement and the transactions contemplated hereby do not and will not violate or conflict any law, regulation authorization, directive, or order (whether or not having the force of law) of which you are subject to, your constitutive documents (where applicable), or any agreement or arrangement to which you are a party or which is binding on you or your assets;
You confirm that the obligations herein are valid, binding, and enforceable to you.
You may only use the FastGames Credits to purchase Services through the FastGame, and each Provider agrees to accept FastGames Credits as payment or part payment by a Recipient for products and Services provided and offered on the FastGame. Each time you use FastGames Credits, you authorize us to reduce the value available by the total amount of the transaction and where applicable, any other applicable fees. You can only make payments to the extent that you have a sufficient balance for FastGames Credits to support the transactions. You will not be allowed to make purchases in excess of the account balance in relation to your FastGames Credits.
You are responsible for all transactions initiated and fees incurred using the FastGames Credits. Any payments made from your FastGames Credits will be deemed to be authorized by you. We will not be liable for any loss resulting from any claims of unauthorized use of your FastGames Credits under any circumstances.
You agree to notify us immediately of any unauthorized use of your FastGames Credits or any other breach of security of which you have knowledge. Notwithstanding such notification, we will not be liable for any loss resulting from any claims of unauthorized use of your FastGames Credits under any circumstances.
Your FastGames Credits are not redeemable for cash and cannot be refunded except at our absolute discretion. They cannot be resold, exchanged, or transferred for value under any circumstances. The FastGames Credits shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.
We reserve the right not to return any disputed funds until such time as the dispute has been resolved.
We reserve the right to carry out any necessary money laundering, terrorism financing, fraud, or any other illegal activity checks, or checks for any breach of the Agreement before authorizing the withdrawal of your funds for the FastGames Credits.
Prices and availability of Services provided on the Site are subject to change without notice. For Services that involve Experience Partners, you acknowledge and agree that each Experience Partner is solely responsible for the accuracy of the information that they have contributed to the listing. Errors on the Site, which may include without limitation errors in the price and description of Services, will be corrected as soon as reasonably possible when discovered. FastGame reserves the right to revoke any stated offer and to correct any errors or inaccuracies, whether or not the Booking Order has been confirmed and you have been charged. If you have already been charged, FastGame will credit you for the amount charged. Individual bank policies may dictate when said amount is credited.
Whilst FastGame shall use every reasonable effort to ensure the accuracy of the Site and to promptly correct any errors, inaccuracies or omissions, it shall not be liable for any loss or damage arising from the same. You acknowledge and agree that such errors may sometimes occur due to software default or other human error and is not in any way intended to mislead or misrepresent to you. As such, FastGame shall not be liable for any loss arising from such error, inaccuracy or omission.
FastGame reserves the right to cancel any Booking Order and refund to you the price of any purchase, even after the relevant Booking Order is confirmed and payment has been received by us. As some experiences are weather dependent, this includes cancellations due to weather conditions. If there is such a cancellation, FastGame will make best efforts to inform you in advance. If the inclement weather occurs during your game, the price of your purchase will be refunded on a case-by-case basis, at FastGame's discretion.
You represent and warrant that:
All content found on the Site or used in the provision of our services, including without limitation logos, design, drawings, trade names, data, photographs, videos, graphics, sounds, and other material of whatever nature, is protected by copyright, trademark, patent, or other proprietary intellectual property rights, and these rights are owned by FastGame and protected in all forms now or developed in the future. All content is copyrighted as a collective work under Singapore and international copyright laws, and FastGame owns, to the fullest extent allowed by law, the copyright of all content.
You are granted a non-exclusive, non-transferable, and revocable license to access the Site and use our Services. You may only download content displayed on the Site for non-commercial, personal use, provided you also (i) abide by all copyright, trademark, and other proprietary notices contained in the material, (ii) do not modify the material, and (iii) do not copy or post the material on any network computer or broadcast the material in any media. It is strictly prohibited to use the content of the Site for public or commercial purposes without written permission from FastGame. It is strictly prohibited to download the product images of the products and Services for sale within this Site. In the event of a breach, we shall be entitled to terminate your account and bring necessary legal action to recover any damage arising from such breach.
By using the Site, you agree that any materials, suggestions, ideas, or comments that you send to FastGame are non-confidential. By submitting any solicited or unsolicited information, you grant FastGame an irrevocable, worldwide, unrestricted, and perpetual license to use such materials, ideas, or comments for any purpose whatsoever to the extent permitted by law.
By using the Site and enjoying our Services, you hereby grant and authorize FastGame the right to take, edit, alter, copy, exhibit, publish, distribute, and make use of any and all pictures or videos taken of you while participating in FastGame activities (collectively, "Likeness"). Your Likeness may be used in and/or for promotional materials including, but not limited to, advertisements, newsletters, flyers, posters, brochures, press kits, social networking sites, websites, and other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats, and markets now known or hereafter devised. This authorization shall continue indefinitely unless otherwise revoked in writing. You understand and agree that Likeness materials shall become the property of FastGame and will not be returned.
Save as otherwise expressly provided herein, any rights not expressly granted to you herein remain reserved by us. A breach of intellectual property rights is a material breach of the Terms and Conditions entitling us to suspend or terminate your account.
FastGame takes copyright infringement very seriously. If you believe that any content on FastGames’s website or content shared through the FastGame infringes on your Intellectual Property Rights, please contact us by sending an email, in English, to our Customer Service Manager at support@FastGames.co, containing the following: (a) a description of the content you believe to be infringing; (b) where FastGames can find the content on the FastGame; (c) the identity of the party you believe owns the copyright; (d) a statement by you that the information in your notice is accurate and, under penalty of perjury, that if applicable, you are the intellectual property owner or authorized to act on behalf of such owner; and (e) your contact information, such as your address, telephone number, and email address. Please take independent legal advice in advance and confirm these requirements with your lawyer.
FastGames is not affiliated with, has no control over, and assumes no responsibility for the content provided, hyperlinks to third-party websites, the representations, policies, practices of, certifications or accreditations provided or offered by any Providers and/or Enterprises. In addition, during the use of the FastGames FastGame or Service, you may be provided with or have access to hyperlinks to other websites or content on the Internet owned or operated by third parties (“Other Links”). Such Other Links are not under our control, and FastGames is not liable for any errors, omissions, delays, defamation, libel, slander, falsehood, obscenity, pornography, profanity, inaccuracy, or any other objectionable material contained in the content or the consequences of accessing any linked website. Any hyperlinks to any other websites or content are not an endorsement or verification of such websites or content, and you agree that your access to or use of such linked websites or content is entirely at your own risk.
By signing this Agreement, you acknowledge that you shall carefully review and read all related terms and conditions of any Third-Party Agreement before entering into a separate agreement(s) directly with the Provider or Enterprise. You also acknowledge that any and all matters relating to the provision of Services save for the use of the FastGame to perform the Services shall be governed under the Third-Party Agreement(s), and FastGames shall not be liable for any Services provided by any Provider or Enterprise.
The Site may contain links to other sites operated by third parties, including but not limited to third-party sites that display the FastGame trademarks ("Third-Party Sites"). These links are available for your convenience and are intended only to enable access to these Third-Party Sites and for no other purpose. We do not have control over such Third-Party Site, and you access them at your own risk.
FastGame does not warrant or make any representation about the substance, quality, functionality, accuracy, fitness for a particular purpose, or any other representation about any Third-Party Site. A link to a Third-Party Site on the Site does not constitute sponsorship, endorsement, or responsibility. FastGame makes no representation or warranty as to any products or services offered on any Third-Party Site. FastGame is therefore not liable for any loss or damage arising out of any such interactions.
9. PARTNERS AND LIMITATIONS OF LIABILITY
For some Services sold on the Site, FastGame acts as an agent for Experience Partners which are third parties who provide some services directly to customers. FastGame makes no warranties, guaranties or representations regarding the standard of any such service.
You agree we may share your contact and name, email address, phone number, or other personal details with Experience Partners.
FastGame has no liability for any act, omission or default, whether negligent or otherwise of any Experience Partner, and no liability for any loss or damage occasioned by any negligent act or omission of any Experience Partner. Where FastGame's liability cannot be excluded, such liability is limited to the value of the Services purchased.
10. ASSUMPTION OF RISK AND USE OF SERVICES
FastGame is a coordination FastGame that brings people together to enjoy physical activities. You understand and agree that physical activities such as soccer carry a certain degree of inherent risk and may result in injury. FastGame is not responsible to ensure the proper construction and maintenance of facilities provided by Experience Partners or other third parties connected with the Services. You knowingly and voluntarily accept and assume any and all risks that may be suffered by you or minors in your charge from the use of the Services.
You understand and agree that all Services must be utilised in a responsible manner, in accordance with any and all signage as well as the directions and instructions of responsible personnel at the facility or FastGame personnel, and with proper accord to your safety, the safety of minors in your charge and the safety of others. You are also responsible for the proper care of your belongings and that of minors in your charge. FastGame shall not be liable for any loss or damage to any property (howsoever caused) while using the Services.
11. DUTY TO CARE AND SUPERVISE
Minors remain under the care and supervision of their parent or legal guardian, or a duly authorized agent of the parent or legal guardian while using the Services. If you are accompanied by a minor, you must complete and execute a Waiver and Consent form provided to you at the Facility or available here.
Further, you represent and warrant that you are the parent or legal guardian of the minors in your company or duly authorized by the parent or legal guardian and assume the duty and obligations of the parent or legal guardian over the minors in your company. Minors may only be allowed to use the Services if their parent or legal guardian completes the Waiver and Consent or if the parent or legal guardian agrees to be bound by the terms of this Agreement. FastGame does not assume responsibility for the care and supervision of any minors using the Services, who shall remain the responsibility of the parent or legal guardian.
12. INDEMNITY
You agree, at your own expense, to indemnify, defend and hold harmless FastGames and its agents, officers, employees, representatives, successors and assigns against any and all losses, damages, liabilities, deficiencies, claims (including any claim brought by or on behalf of a minor in your charge against FastGame), actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorneys' fees, that are incurred by Indemnified Party (collectively, "Losses"), arising out of or related to (i) breach or non-fulfillment of any obligations by you or any minors in your charge of these terms (ii) any negligent or more culpable act or omission (including any reckless or willful misconduct) by you or any minors in your charge including but not limited to any breach of your duty to care and supervision of minors (iii) any bodily injury, death of any person, or damage to real or tangible personal property caused by the acts or omissions of you or any minors in your charge (including any reckless or willful misconduct) (iv) any failure by you or any minors in your charge to comply with any applicable laws, regulations, or codes in the use of Services or (v) unaccompanied minors where you have consented to their unaccompanied use of the Services.
13. SECURITY
If you use the Site, you are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account and password.
You also agree to immediately notify us of any attempted or actual unauthorized access or use of our services by third parties and/or any other breaches of security. You acknowledge and agree that we will not be in any way liable, directly or indirectly, for any loss arising from such unauthorized use or any acts or omissions on your part in maintaining the confidentiality of your account and password.
You acknowledge that the technical processing and transmission of electronic communications is necessary for your use of our Services. You consent to our interception and storage of electronic communications and/or your data and acknowledge that your electronic communications will involve transmission over the internet, and over various networks, some of which may not be owned and/or operated by us. This includes but is not limited to transactions associated with Experience Partners, payment processors, credit cards, or banks.
You further acknowledge that changes to your electronic communications may occur so as to conform and adapt such data to the technical requirements of connecting networks and devices. You also acknowledge that such electronic communications may be accessed by unauthorized parties when communicated across electronic means. As such, we are not liable for any data lost or intercepted without authorization during such transmission.
You are prohibited from violating or attempting to violate the security of FastGame in any manner, including, without limitation:
Violations of system or network security may result in civil or criminal liability.
We may disclose information, including personal information, with other organizations for credit fraud protection and risk reduction in accordance with applicable laws. We may also disclose any information, in our sole discretion, to comply with any applicable law, regulation, legal process, or governmental request. In cases of fraud, the proper authorities will be informed and legal action will be taken.
At FastGame, protecting your information is a priority. To prevent unauthorized access and maintain data accuracy, we have put in place appropriate procedures to safeguard and secure the information we collect online. Please refer to the Privacy Policy below for more details.
14. VARIATION
We reserve the right to amend or vary the Terms and Conditions at our discretion at any time.
If any changes are made, you will only be notified via message after you log in to your account. Each time you see this notification, you should visit and review the then current Terms and Conditions. If you are dissatisfied with the Site or do not accept the Terms and Conditions, please discontinue your use of the Site. Your continued use of the Site and your submission of any Booking Order or other request to shall be construed as your acceptance of the amended Terms and Conditions.
15. DISCLAIMERS AND EXCLUSIONS
FastGames excludes all representations, warranties, conditions and terms express or implied by statute, common law or otherwise to the fullest extent permitted by law. FastGames accepts no liability for any special, indirect, incidental, consequential or economic loss howsoever caused arising out of or in connection with this Agreement.
You agree that your access to and use of the Services, and the content available through the Services is on an “as is”, “as available” basis. FastGames provides the FastGame and Services in good faith but gives no warranty or representation that the content provided on the FastGame is accurate, complete or up-to-date, including but not limited to, any representations or warranties of merchantability, fitness for a particular purpose, or representations or warranties against interference or infringement.
FastGames accepts no responsibility or liability for your use of the FastGame and such use is entirely at your own risk. While FastGames takes reasonable precautions to prevent the existence of computer viruses and/or other malicious programs on the FastGame, FastGames accepts no liability for them.
Information transmitted via the FastGame will pass over public telecommunications networks, such as the internet. FastGames makes no representation or warranty that the operation of the FastGame will be uninterrupted or error free and disclaims all liability in respect thereof. FastGames may communicate information to you or other Users via electronic mail, and makes no representation or warranty on behalf of the uninterrupted or error free operation of your electronic mail service, or any other third party, or that your email service will properly process our communications.
10.5. The Services may be subject to delays, cancellations and other disruptions. FastGames makes no warranty, representation or condition with respect to the Services, including but not limited to, the quality, effectiveness, reputation and other characteristics of the Services.
10.6. The content on the FastGame does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. No advice or information, whether oral or written, obtained from FastGames or through the User Interface or FastGame will create any warranty not expressly made herein. You agree that your use of the FastGame is at your sole risk.
10.7. Any content downloaded from or otherwise accessed on the FastGame and/or through the User Interface is accessed at your own risk, and you shall be solely responsible for any damage to your property, including but not limited to, your computer system and any device you use to access the FastGame through the User Interface, or any other loss that results from accessing such content.
10.8. FastGames reserves the right to suspend your use of the FastGame at any time for operational, regulatory, legal or other reasons. FastGames may terminate your use of the FastGame with immediate effect if you breach any terms in the Agreement.
10.9. FastGames shall have no liability to you for any breach of the terms in the Agreement caused by any event or circumstances beyond our reasonable control including but not limited to Force Majeure Events.
10.10. Under no circumstances, including but not limited to, negligence, shall FastGames or its affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, the FastGame, unauthorised access to or alteration of your transmissions or data, the FastGame, or any errors or omissions on the FastGame, even if advised on the possibility of such damages. You specifically acknowledge and agree that FastGames is not liable for any conduct of any User.
10.11. Additionally, the FastGame may contain links to other websites, applications and/or services from third parties. FastGames accepts no responsibility or liability for any material supplied by or contained on any third party websites which is linked from or to this FastGame, or any use of personal data by such third party. Any dealings you have with any third party advertisers or sponsors are solely between you and such advertiser or sponsor. FastGames has no control over such third party service or content providers, and does not endorse and is not responsible for any content, accuracy, quality, products or other materials on or available from such external services.
10.12. FastGames shall not in any event be liable to you or any third party for any indirect, incidental, consequential, special or exemplary damages, including but not limited to any loss of profits, revenues, business opportunities or for loss of income, bargain, revenue, contracts, goodwill, use, reputation, anticipated savings, enjoyment, time, data, or electronically transmitted information or damages or costs due to loss of production or use, business interruption, procurement of substitute goods or services, or property damage or emotional distress, whether or not FastGames has been advised of the possibility of such damages, arising out of or in connection with this Agreement and/or the use of the FastGame, to the extent permitted by law.
10.13. In the event any limitation or provision contained in the Agreement is held to be invalid for any reason, FastGames’s total liability (whether in contract, tort, negligence or on any other basis) to you, for any loss or damage shall be limited to the sums paid by you to FastGames for the Services.
To the maximum extent permitted by law, FastGame and its Associates shall not be liable to you or any third party for any direct, indirect, incidental, special, punitive or consequential loss and damages whatsoever and howsoever caused arising from this Agreement or that result from your use of the Site, its content and services, any system failure, error, interruption, delay in transmission, or computer virus or otherwise including but not limited to reliance by you on any information obtained from the Site that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, or any failure of performance or for any loss of data, profit, revenue, income or business, whatsoever and howsoever caused whether arising out of any negligence or breach of these terms and conditions even if such loss and damage was foreseeable by or the possibility was brought to the attention of FastGame.
To the maximum extent permitted by applicable laws, in the event that we are liable for any loss, damage or claim to you or any third party caused by our act, default or neglect, our liability shall not exceed 100% of the Price for the affected transaction for which loss, damage and claim are raised thereunder. Notwithstanding the foregoing, nothing in the Terms and Conditions excludes, restricts or modifies any condition, warranty, right or liability implied into the Terms and Conditions where to do so is illegal or would render any provision hereof void.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the Parties relating to the subject matter of this Agreement and supersedes and extinguishes any prior drafts, agreements, undertakings, representations, warranties and arrangement of any nature, whether or not in writing, between the Parties in relation to the subject matter of this Agreement.
17. TERMINATION OF USE
You may also cancel your use of our Services at any time following the instructions located on the Site. Termination will be immediate and result in irreversible deletion of all account data. Users have the right to have their data erased in certain situations and may contact us here to exercise any applicable rights to delete personal data.
FastGame may, in its sole discretion, block access, delete the content, suspend or terminate your right to use our services or terminate your account without notice and for any reason, including but not limited to any breach any material term of this Agreement.
In the event of suspension or termination of your account, we shall not be held liable for any loss you may suffer as a result. Upon termination, we have no obligation to grant you access to our services. Termination of your account for whatever reason shall not prejudice or impair any antecedent right or obligation of parties that accrued prior to termination. You are personally liable for any orders that you place or charges that you incur prior to termination.
18. FORCE MAJEURE
Neither party will be liable for any delay or failure to perform its obligations pursuant to this Agreement as a result of any cause beyond its reasonable control including but not limited to acts of God, unusually severe weather, destruction by fire or flood, power failure, interruption or failure of electricity and power, malfunction or damage to computer systems, acts of governments, acts of terrorism, hostilities between nations, war, strikes, boycotts, lockouts, industrial and labour dispute, infectious diseases, epidemics, provided that such performance shall be excused only to the extent of and during such disability. If such delay or failure continues for at least ninety (90) days, either party will be entitled to terminate this Agreement by notice in writing.
19. ASSIGNMENT, NOTICES, WAIVER, REMEDIES, SURVIVAL
FastGame may assign or transfer any of FastGame rights under this Agreement to any Person. You shall not assign or transfer your rights or obligations under this Agreement without FastGame prior written consent.
This Agreement shall be binding upon and inure to the benefit of the heirs, executors, administrators, successors and assigns of parties.
Unless otherwise expressly stated in the Agreement, notices shall be in writing and may be delivered by hand, or by ordinary or registered mail or by electronic mail to the last known addresses. Notice will be deemed given: (a) in the case of hand delivery or registered mail, upon written acknowledgement of receipt by a duly authorized representative of the receiving party (b) in the case of ordinary mail, forty-eight (48) hours after posting or (c) in the case of electronic mail, at the time when the mail was sent and stored in the information system of the sender.
Any waiver of any right or consent given under this Agreement is only effective if it is in writing and signed by the waiving or consenting party. No delay or failure to exercise any right under this Agreement shall operate as a waiver of that right. No partial exercise of any right shall prevent any further exercise of that right, or any other right.
No remedy conferred by any of the provisions of this Agreement is intended to be exclusive of any other remedy which is otherwise available at law, in equity, by statute or otherwise, and each and every other remedy shall be cumulative and shall be in addition to every other remedy given hereunder or now or hereafter existing at law, in equity, by statute or otherwise. The election of any one or more of such remedies by any of the parties shall not constitute a waiver by such party of the right to pursue any other available remedies.
Provisions of this Agreement which either are expressed to survive its termination or from their nature or context it is contemplated that they are to survive such termination shall remain in full force and effect notwithstanding such termination.
20. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by the law of Singapore. Both parties irrevocably and unconditionally submit to the exclusive jurisdiction of the Singapore courts.

23. SUCCESSION
This Agreement will bind and benefit each Party’s successors and personal representatives.
24. CONFLICTS
In the event of any conflict, dispute or discrepancy between the terms under this Agreement and any Third Party Agreements, the terms under this Agreement shall prevail.
25. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by, and construed in accordance with, the laws of Singapore. Each Party irrevocably agrees that the courts of Singapore shall have exclusive jurisdiction in relation to any claim, dispute or difference arising from or relating to this Agreement or any matter arising therefrom and each Party irrevocably waives any right that it may have to object to an action being brought in those courts, to claim that the action has been brought in an inconvenient forum, or to claim that those courts do not have jurisdiction.
By using our site (navigating, registering with us, booking a game, etc.), you agree that you have read, understood, and agree to be bound by the terms of the Agreement, and are deemed to have accepted and executed this Agreement electronically, effectively on the date you register your account or click to accept this Agreement.
